Course Overview

CTCL is inviting applications for its flagship Online Diploma course on “Insolvency and Bankruptcy: Law and Practice”. This one of its kind course aims to introduce legal and secretarial practitioners and students to the insolvency laws in India as conceptualized within the larger family of commercial laws including corporate laws, security transaction laws and recovery laws. A unique objective of this course is to juxtapose the legal principles and propositions within the realm of entrepreneurship and to develop a cumulative and comprehensive understanding of insolvency laws in the context of entrepreneurship. The course also aims to acquaint and equip the attendees with the practical skills necessary to practice insolvency laws in the Indian courts along with the requisite negotiation and problem-solving skills.

 

Programme Highlights

  • Understand various aspects of insolvency law in India along with its interaction with the relevant corporate laws
  • Gain expertise in the application of Insolvency and Bankruptcy Code, 2016 along with the various procedures connected thereto
  • Develop skills required to practice insolvency law, effective drafting of pleadings, negotiation with parties etc.
  • Understand the juxtaposition of insolvency laws with entrepreneurship along with developing a conceptual understanding of their interplay in both theoretical and practical terms
  • Analyse the Indian insolvency law in context of the insolvency regimes in various other countries for a more comprehensive and global outlook with an ability to engage in critical scholarship on issues of law and policy
  • Equips the attendees with theoretical and practical skills for decision-making and leadership positions in any industry that leverages insolvency related commercial laws.

 

Course Outline

The course will be administered during the course of a six months period and will be divided in six modules-

  1. Introduction to Insolvency, Evolution of Insolvency Regime, Why Businesses Fail?
  2. Nature of Securities and Debt Recovery Framework in India
  3. Restructuring/ Out of Court Work-Out
  4. Introduction to the Insolvency & Bankruptcy Code, 2016; Corporate Insolvency and Liquidation; Legal and Regulatory Framework in post COVID times
  5. Bankruptcy of Individuals and Partnership Firms
  6. Developing practical skillsets insolvency law and entrepreneurship

 

Methodology of Instruction

  • The course will be administered entirely through online medium. Requisite reading materials and pre-recorded lectures shall be provided to the enrollees to allow flexibility and customization in the learning.
  • The self-paced learning process of the course will allow the enrollee to engage with the course material in depth and at convenience with the liberty to seek guidance from the instructors at any junction.
  • Questions and assignments will be made available at the end of each module and shall contribute towards the cumulative assessment of the enrollee.
  • Monthly webinars shall be conducted with industry experts to discuss issues of contemporaneous relevance and enable the participants to interact with the needs of the industry.

Course Eligibility

The minimum eligibility for applying for this programme is a graduate degree (in law or other field) from a recognized university. Students in the 4th and 5th year of 5 years integrated law course or in the final year of 3 years LLB degree can also apply.

Students with a degree certificate or its equivalent from any UGC-recognized university, Association of Indian Universities, CA, CS, ICWA, Open University/distance learning can apply. There shall be no restriction as to age, nationality, gender or employment status in the admission process.

A basic understanding of insolvency law specifically the Insolvency and Bankruptcy Code, 2016 will be helpful but is not mandatory.

The registration amount will be adjusted in the course fees.

Admissions can be completed by 20th October 2020.

The program will commence with effect from 1st November 2020.

 

Fees

Fee for the course is Rs. 50,000/= per student, all inclusive. Reading materials shall be shared online in soft copies.
